These Terms of Service ("Terms") are a binding agreement between you ("you", "your") and EndpointOS ("we", "us", "our") and govern your access to and use of the EndpointOS websites, dashboards, APIs, and related services (collectively, the "Service"). By creating an account or otherwise using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
EndpointOS is part of the Baseframe Labs family of products (baseframelabs.com). Each product is governed by its own Terms; these Terms apply only to EndpointOS.
1. Your account
You must be at least 16 years old to use the Service. You are responsible for the accuracy of the information you provide and for all activity that occurs under your account. You must keep your password and any API keys confidential. Anyone in possession of an API key can act on your behalf, up to the permissions granted to that key. Notify us promptly at support@baseframelabs.com if you suspect unauthorised access.
2. Acceptable use
You agree not to use the Service to:
- Break any law, regulation, or third party's rights.
- Send spam, phishing content, malware, or material that infringes intellectual property or privacy.
- Attempt to disrupt, degrade, or gain unauthorised access to the Service or any other customer's data.
- Reverse engineer, scrape, or attempt to extract source code from the Service except to the extent permitted by applicable law.
- Use the Service to operate a competing API hosting product without prior written consent.
- Use the public API surface to bypass per-plan limits, including rotating accounts, fragmenting workloads across projects, or other clear evasions.
We reserve the right to suspend or terminate accounts that materially violate these terms.
3. Your content and your APIs
You own the resources, schemas, records, contracts, documentation, and any other data you create or upload to the Service (collectively, "Customer Content"). You grant us a limited, worldwide, non-exclusive licence to host, store, transmit, process, and display Customer Content solely as needed to operate the Service for you.
You are responsible for the legality of Customer Content and for obtaining any necessary rights, consents, and permissions from end users whose data you process through the Service. You should publish your own privacy policy and terms when you expose APIs to third parties.
4. API keys, secrets, and signed payloads
We store API keys as salted hashes and webhook signing secrets encrypted at rest. The plaintext value of each secret is shown to you only once at creation. We cannot recover a lost secret; rotate or recreate it. You are responsible for distributing, rotating, and revoking your secrets, and for verifying signatures on any webhook payloads you receive.
5. Plans, limits, and changes
The Service is offered today as a free early-access plan with monthly request limits and feature caps documented in the dashboard. Paid plans (Pro, Team, Business, Enterprise) are listed for transparency but are not yet billed. We may introduce billing for paid plans on at least 30 days' notice. We may also adjust quotas on the free plan with at least 14 days' notice when reasonably required to keep the Service healthy.
We may apply temporary throttling to protect the Service from abuse or fair-use violations. If we do this to your account we will tell you why.
6. Service availability
We work to keep the Service highly available, but we do not promise uninterrupted or error-free operation. Scheduled maintenance, platform incidents at our sub-processors (Supabase, Vercel), or upstream network failures may cause interruptions. The Service is provided on an "as is" and "as available" basis.
7. Termination
You may stop using the Service at any time and delete your account from your dashboard. We may suspend or terminate your access for material breach of these Terms, for risk to the Service or other customers, or where required by law. After termination we will retain Customer Content per the schedule in our Privacy Policy and then delete it.
8. Disclaimer of warranties
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any implied warranty arising from course of dealing or usage of trade.
9. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, or business opportunities, even if advised of the possibility of such damages. Our aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the fees you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred US dollars (USD 100). Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnification
You agree to defend, indemnify, and hold harmless EndpointOS and its officers, contractors, and agents from any third-party claims, damages, or expenses arising from (a) your Customer Content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your violation of any third party's rights.
11. Changes to the Service or these Terms
We may modify the Service from time to time. We may update these Terms by posting the revised version with a new effective date; material changes will be communicated at least 14 days before they take effect, via email or in-dashboard notice. Continued use of the Service after that effective date constitutes acceptance of the updated Terms.
12. Governing law and disputes
These Terms are governed by the laws of the United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in the United States, and you consent to personal jurisdiction in those courts.
13. Miscellaneous
These Terms are the entire agreement between you and EndpointOS regarding the Service. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms in connection with a corporate transaction.
